Terms of Service
These terms cover this website and the Lanterlink Care Portal. If your agency has signed a subscription agreement with us, that agreement comes first wherever the two disagree.
Which document wins. Your agency’s subscription agreement and Business Associate Agreement take precedence over anything on this page. These terms are the baseline for everyone else.
1. Who these terms bind
Browsing this website means you accept these terms. Signing into the portal means you accept them on behalf of the agency that issued your account, and that you have that agency’s permission to do so.
2. Accounts and acceptable use
Portal accounts are issued by an agency to its own staff. You agree to:
- Use the portal only to do work for the agency that issued your account.
- Keep your credentials to yourself — accounts are personal and are not to be shared.
- Not attempt to reach data belonging to another agency, or to any site or person you are not assigned to.
- Not upload files unrelated to authorized care delivery.
We may suspend an account that appears to be compromised or misused, and we will tell the agency as soon as we reasonably can once the account is secure.
3. Health information
Lanterlink acts as a Business Associate to the agency that issued your account, under a separately signed Business Associate Agreement. How we may handle health information is governed by that agreement, which prevails over these terms wherever they conflict.
4. Service availability
We announce planned maintenance in the portal ahead of time. Urgent work needed to keep the service safe or secure may have to happen without that notice. We do not guarantee uninterrupted access, and these terms do not include an uptime service-level commitment. If your agency has agreed availability terms with us, they are in its subscription agreement.
5. Your data
The records an agency puts into the portal belong to that agency. We claim no ownership of them. While its account is active and its fees are current, an agency can export its data at any time, and we do not hold it hostage to a renewal.
6. Fees
Subscription pricing is stated on our pricing page and in the agency’s subscription agreement. Plans run month to month unless agreed otherwise, and can be changed or canceled by the agency.
7. What we do and do not promise about the service
We work hard to make Lanterlink accurate and available, but the service is provided as is. To the extent the law allows, we make no warranties of any kind about it — including any implied warranty that it is fit for a particular purpose, merchantable, or free of errors or interruption. Some states do not allow those disclaimers, in which case this paragraph applies as far as the law permits and no further.
8. Limitation of liability
To the extent the law allows, Lanterlink’s total liability arising out of the service is limited to the fees the issuing agency paid us in the twelve months before the claim. We are not liable for indirect or consequential losses.
Nothing in these terms limits liability that cannot lawfully be limited.
9. If someone brings a claim because of how you used the portal
If a third party makes a claim against us because an account holder broke these terms, misused the portal, or broke the law while using it, that account holder’s agency agrees to cover the costs we reasonably incur defending it. This does not apply to anything caused by us.
10. The portal is a record-keeping tool
Lanterlink helps agencies record, organize and report the work they do. It does not provide clinical, legal, tax, or regulatory advice, and it does not decide whether an agency is compliant. Responsibility for the accuracy of records and for meeting regulatory obligations stays with the agency.
11. Termination
Either party may end the subscription on thirty days’ written notice. The agency can export its data at any point up to the end date, and we will help if it asks. After that, its data is deleted in line with the Business Associate Agreement.
12. Changes to these terms
If we change these terms materially, we will update the date at the top and tell customers in the portal.
13. Governing law
These terms are governed by the laws of the State of California, United States.
